Overview
Tracey A. Werner is a partner and shareholder at Maire, Powell & Werner. Her practice focuses on representing public entities and law enforcement in civil rights claims under 42 U.S.C. §1983, as well as general tort liability and premises liability matters. Ms. Werner also advises K–12 school districts and community college districts on a wide range of legal issues.
Ms. Werner attended Cal Poly, San Luis Obispo and Cal Northern School of Law in Chico, California, where she graduated as Salutatorian and earned Witkin Awards in both Torts and Contracts. Before joining the firm in 2017 she practiced at a general practice firm, handling estate planning, family law, workers’ compensation, and civil litigation involving contract, business and real property disputes.
Ms. Werner is admitted to the State Bar of California, the United States District Courts for the Eastern and Northern Districts of California, the Ninth Circuit Court of Appeals, and the Supreme Court of the United States.

Presentations
Ms. Werner has presented for DRI on e-discovery and on representing municipalities in Monell claims, and for the Trindel Insurance Fund on the Heck doctrine and Penal Code sections 69 and 148 convictions.
Outside the office she enjoys “flamping” and exploring national parks with her husband and two young sons.
